Terms and Conditions
Below you will find our General Terms and Conditions. If you are organising a seminar with us, please select “GTC Seminars”. If you are staying with us as an individual guest or have booked one of our in-house experiences, please select “GTC Individual Guests”. If you have any questions, we are happy to help.
1. Scope of Application
These General Terms and Conditions for Group Stays (GTC Groups) apply to the provision of rooms and/or seminar facilities as well as to all related services and deliveries provided by Berglodge37 AG (hereinafter referred to as Berglodge37) to customers (hereinafter referred to as “organisers”). Any subletting or re-letting of rooms or areas by the organiser requires the prior written consent of Berglodge37.
All offers made by Berglodge37 are based on these GTC. They form an integral part of every contract. Berglodge37 reserves the right to make changes to the GTC at any time and publishes the current version on its website. By using the services of Berglodge37, the organiser accepts the current terms and conditions. Individual changes to these terms and conditions require an express written agreement between the parties. This also applies to the waiver of the written form requirement. If these terms and conditions contradict any contractual conditions of the organiser, these terms and conditions shall take precedence.
2. Reservations
A contract between Berglodge37 and the organiser is concluded when an offer from Berglodge37 is confirmed in writing by the organiser through a booking. Amendments to the contract content are binding only once confirmed in writing by Berglodge37.
2.1 The acceptance period for offers is 14 days unless otherwise agreed. After this period, Berglodge37 is no longer bound by the offer and reserves the right to withdraw from an offer for important reasons.
2.2 The organiser has no claim to specific rooms; however, Berglodge37 undertakes to provide rooms within the reserved category.
2.3 Options are binding for both parties during the agreed option period. After expiry of this period, Berglodge37 may freely dispose of the reserved dates and services.
3. Prices / Payment Terms
All prices are quoted in Swiss francs (CHF), including VAT, excluding tourist taxes.
3.1 Price changes by Berglodge37 are expressly reserved.
3.2 A deposit of 25% of the quoted amount is required, payable 90 days prior to arrival. Invoices are issued approximately 120 days before arrival. For reservations with a foreign billing address or bookings made from abroad, Berglodge37 may require a deposit of up to 100% of the reserved services. If the organiser fails to pay the deposit on time, Berglodge37 is entitled to withdraw from the contract in accordance with section 11. Deposits will be offset in accordance with sections 3.1–3.5 of these GTC.
3.3 Invoices must be paid within 30 days of the invoice date without deduction. Services are deemed to have been provided correctly and in full if no objection is raised within the payment period.
3.4 In the event of late payment, Berglodge37 reserves the right to charge reminder fees and address investigation costs.
3.5 The organiser is not entitled to any refund for unused services included in the offer.
4. Cancellation / Postponement / Changes in Number of Participants
Cancellations, postponements and changes in the number of participants are only accepted in written form.
4.1 The cancellation conditions in the event of a complete cancellation of an event are as follows, regardless of group size:
| up to 90 days before arrival: | no charges |
| 89 to 60 days before arrival: | 20% of the reserved services |
| 59 to 20 days before arrival: | 50% of the reserved services |
| 19 to 6 days before arrival: | 80% of the reserved services |
| from 5 days before arrival: | 100% of the reserved services |
| during the stay: | 100% of the remaining services |
For exclusive rental (reservation of the entire Berglodge37), the following cancellation conditions apply:
| up to 120 days before arrival: | no charges |
| 119 to 90 days before arrival: | 20% of the reserved services |
| 89 to 60 days before arrival: | 50% of the reserved services |
| 59 to 20 days before arrival: | 80% of the reserved services |
| from 19 days before arrival: | 100% of the reserved services |
| during the stay: | 100% of the remaining services |
4.2 A postponement is generally treated as a cancellation and handled accordingly. However, if the cancellation / postponement takes place no later than 60 days before arrival, a one-time postponement may be granted under the following conditions: The new event date must be communicated in writing within 7 days after the postponement request, the event must take place within 12 months of the original date and Berglodge37 must have the corresponding availability.
The costs incurred at the time of cancellation in accordance with section 4.1 will initially be invoiced, but will be fully credited to the final invoice if the event actually takes place (provided the above conditions are fulfilled). If one or more of these conditions are not met, the cancellation conditions according to section 4.1 apply in full.
4.3 Changes in participant numbers: The organiser undertakes to inform Berglodge37 of any changes in the number of participants as early as possible. Berglodge37 will make every reasonable effort to reallocate unused reservations. If successful, no costs will be charged to the organiser.
A reduction in the number of participants is possible within the following tolerances:
| up to 90 days before arrival: | no charges |
| up to 60 days before arrival: | up to 25% of the confirmed number of participants |
| up to 20 days before arrival: | up to 15% of the confirmed number of participants |
| up to 7 days before arrival: | up to 10% of the confirmed number of participants |
The originally confirmed number of participants and the date of the latest reduction are decisive for calculating the free reduction allowance. Reductions are calculated cumulatively.
Any reductions exceeding these tolerances are considered partial cancellations and will be charged in accordance with the cancellation conditions under section 4.1.
The final and binding number of participants must be communicated to Berglodge37 in writing no later than 7 days before arrival and forms the basis for invoicing.
Reductions made 6 days or less before arrival will be charged at 100% in all cases.
5. Detailed Information / Event Schedule
To ensure smooth organisation, all relevant details (e.g. schedule, room setup, participant list) must be provided no later than 14 days before arrival. The communicated meal times apply and the agreed schedule must be adhered to by both parties.
The participant list must include:
- First and last names, email address and mobile phone number
- Allergies and intolerances
6. Bringing Food and Beverages
Bringing food and beverages is generally not permitted. Exceptions require a written agreement with Berglodge37.
7. Use of Rooms
Berglodge37 reserves the right to provide a suitable alternative room in the event of reduced participant numbers and may, in exceptional cases, make short-notice room changes without prior notice. Promotional materials outside rented rooms require prior agreement.
Seminar rooms are charged on a half-day basis. Rooms are available from 2:00 pm on arrival day and must be vacated by 12:00 noon on departure day. Additional setup or modification work will be charged at CHF 90 per hour.

9. Liability for Payment / Duty of Care
The organiser is liable for the full invoice amount, including services used by employees, agents and participants, unless otherwise agreed in writing.
9.1 Berglodge37 accepts no liability for loss, damage or theft of items brought in by the organiser or participants.
9.2 Rooms and equipment must be used with due care. The organiser is liable for any damage or loss.
9.3 Berglodge37’s liability is governed by statutory provisions.
10. Fire Safety / Security Regulations
All fire safety and security regulations must be observed, including bans on candles, incense, smoking and the obstruction of escape routes. Decorations must comply with fire safety regulations.
11. Withdrawal by Berglodge37
If the customer is entitled to cancel free of charge in accordance with clause 4 or a separate agreement, Berglodge37 is entitled to withdraw from the contract during this period if there are enquiries from other customers for the contractually booked premises and the customer does not waive their right to cancel free of charge upon enquiry by Berglodge37.
If the agreed deposit terms are not met by the organiser, Berglodge37 is entitled to withdraw from the contract without compensation.
Furthermore, Berglodge37 is entitled to withdraw from the contract for objectively justified reasons, for example if:
- force majeure or other circumstances beyond the control of Berglodge37 make it impossible to fulfil the contract (e.g. transport of guests to Berglodge37 is not guaranteed, interruption of mountain railway operations, natural forces, foehn storms, pandemic-related restrictions). Berglodge37 is not liable for further damages (e.g. travel costs, loss of wages, etc.).

In the event of justified withdrawal by Berglodge37, the customer shall not be entitled to further compensation.
